Proposed Actions

The following is a list of actions proposed by the Registrar under subsection 41(1) of the Condominium Management Services Act, 2015 (CMSA). Please note that the actions listed below have not yet been disposed of, meaning, the licensee still has an opportunity to appeal the action at the Licence Appeal Tribunal.

Information on licensees

36. (1) The registrar shall make the following information available, without charge, to the public:

8. If the registrar has proposed under subsection 41 (1) of the Act to take an action described in that subsection with respect to an applicant or licensee and the proposal has not yet been disposed of, an indication of that fact.

(2) Subject to subsection (3), if the registrar becomes aware of information respecting a licensee, former licensee, a director or officer of a licensee or a person who is carrying on activities that require a licence and if the registrar is of the opinion that the information could assist in protecting the public if the public knew of it, the registrar shall make the information available to the public.

(3) The registrar shall not make any information available to the public under subsection (2) if it is financial information relating to a person or the business of a person and the person could reasonably expect that the information be kept confidential.

Completed Actions

What follows is a list of cases where the Registrar has refused to renew a licence, has revoked a licence, or has suspended a licence, and cases where the Licence Appeal Tribunal has issued an Order against a licensee of the CMRAO.

Licence Appeal Tribunal (LAT) Orders

April 5, 2024 Bert Berger

Pursuant to an Order of the Licence Appeal Tribunal, the Registrar of the Condominium Management Regulatory Authority of Ontario (“CMRAO”) revoked the General Licence of Bert Berger.

March 10, 2023 Andreea Mardare

Pursuant to an Order of the Licence Appeal Tribunal, the Registrar of the Condominium Management Regulatory Authority of Ontario (“CMRAO”) refused to issue a General Licence and revoked the Limited Licence of Andreea Mardare.

May 26, 2022 Anil Jhamtani

Pursuant to an Order of the Licence Appeal Tribunal and sections 40 and 41(1)(b) of the Condominium Management Services Act, 2015, the Registrar has revoked the General Licence of Anil Jhamtani, effective May 26, 2022 (see Registry Profile for further details).

May 26, 2022 Simsons Management Inc.

Pursuant to an Order of the Licence Appeal Tribunal and sections 40 and 41(1)(c) of the Condominium Management Services Act, 2015, the Registrar has applied the conditions set out below to the licence of Simsons Management Inc (see Registry Profile for further details):

· Anil Jhamtani shall not be a director or officer of Simsons Management Inc.

· Anil Jhamtani shall not provide condominium management services or perform any of the functions of a condominium manager on behalf of Simsons Management Inc. and/or for any clients of Simsons Management Inc.

· Within one year of the date that this condition takes effect, Simsons Management Inc. is required to comply with an inspection with an inspector appointed by the Registrar. In particular, the inspector shall inspect:

i. Simsons Management Inc.’s compliance with the conditions of its licence and with the Condominium Management Services Act, 2015

ii. Simsons Management Inc.’s written procedures for handling the transfer of client documents upon termination

April 29, 2022 F&W Property Management (Kitchener) Limited (“F&W”) and Laurie Brown

Pursuant to an Order of the Licence Appeal Tribunal and Minutes of Settlement entered between the licensees and the CMRAO, F&W and Laurie Brown have agreed to wind down F&W’s business, transition its clients to other licensed condominium management providers, and voluntarily cancel F&W’s licence with the CMRAO (see Registry Profile for further details).

Laurie Brown has agreed not to apply for a General Licence with the CMRAO and has consented to the following conditions being applied to any licence she may hold with the CMRAO:

· Ms. Brown shall not make expenditures of any amount, invest, or otherwise make dispositions of a client’s money

· Ms. Brown shall not have signing authority over a client’s bank accounts

February 14, 2022 Millcreek Management Inc.
