TORONTO, ON, September 20, 2021 – On August 13, 2021, after the CMRAO concluded an investigation related to unlicensed practice at a condominium corporation in Toronto, the following persons were convicted for offences related to unlicensed practice under the Condominium Management Services Act, 2015 (CMSA):

• Nick Lombardi: performing the functions of a condominium manager without a licence, violating s. 34(2)(b) of the CMSA ($3,500 fine)
• MF Properties Limited (licence number: 0022446517-CMP): knowingly assisting Nick Lombardi in performing the functions of a condominium manager without a licence, violating s. 56 of the CMSA ($5,000 fine)
• Victor Wai Tat Ngai (Victor Ngai), Principal Condominium Manager at MF Properties Limited (licence number: 0021400902-GL):
  • Count 1: knowingly assisting Nick Lombardi in performing the functions of a condominium manager without a licence, violating s. 56 of the CMSA (suspended sentence)
  • Count 2: failing to take reasonable care to prevent MF Properties Limited from knowingly assisting Nick Lombardi in performing the functions of a condominium manager without a licence, violating s. 56 of the CMSA ($3,500 fine)

As of November 1, 2017, any individual providing condominium management services in Ontario is required to have a licence issued by the CMRAO. Nick Lombardi never held a licence despite providing condominium management services to a condominium corporation from November 1, 2017, to July 27, 2020. Although the Condominium Authority of Ontario listed Mr. Ngai as the condominium manager and MF Properties as the condominium management provider, Mr. Lombardi performed the condominium management duties for the corporation. This included exercising the delegated powers and duties of the Board of Directors, and supervising contractors hired by the condominium corporation, with the knowledge of Mr. Ngai and MF Properties.

By failing to take the necessary steps to prevent Mr. Lombardi’s unlicensed practice, Mr. Ngai (the Principal Condominium Manager) and MF Properties knowingly assisted Mr. Lombardi in performing the functions of a condominium manager without a licence, despite their obligations as licensees. Mr. Lombardi, Mr. Ngai, and MF Properties have been convicted of the offences listed above under the Condominium Management Services Act, 2015, and are obligated to pay fines totalling $12,000.
