A Deep Dive into Proactive Inspections

Last year, the CMRAO expanded its proactive inspections program to include a focus on condominium management provider businesses’ processes for supervising Limited Licensees, and ensuring staff are properly licensed and adhering to the parameters of the licence. The CMRAO also began consultations on how to conduct inspections of providers’ financial management practices.

Licensees are chosen for an inspection at random or may be selected based on other factors. These inspections are not meant to be punitive or disciplinary. The purpose is to review a licensee’s business practice and ensure compliance with the governing legislation.

Steps Involved in a CMRAO Inspection

  1. The CMRAO contacts the Principal Condominium Manager (PCM) with a Notice of Inspection.
  2. The inspector meets with the management provider and gives them instructions on how to complete the required forms and checklists.
  3. The provider returns the forms and checklists to the inspector (documents must be returned within four weeks).
  4. The inspector submits their inspection report to the CMRAO.
  5. The CMRAO reviews the inspector’s report and prepares a summary of findings and recommendations. The summary might contain a:
    • Directive – immediate remediation on the basis of clear non-compliance with legislation is required
    • Recommendation – developed to prevent possible non-compliance and establish standardized written processes 
  6. The CMRAO shares its findings and recommendations with the provider business.
  7. If the summary contains a directive, the CMRAO and provider business meet to review the findings and directives.

The CMRAO provides informative guides and detailed checklists to give licensees an overview of the process and help them prepare for inspections.
